Terms of Service

By accessing or using Tenairis (the "Service") you agree to be legally bound by these Terms. If you do not agree, you must not use the Service. We may update these Terms at any time; continued use constitutes acceptance of the updated version.

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into a contract. You are solely responsible for the activity on your account, the accuracy of the information you provide, and for keeping your credentials confidential. We may refuse, suspend, or terminate any account at our sole discretion, without notice and without liability.

Paid plans renew automatically until cancelled. Credits, whether granted by a subscription or purchased one-time, are a limited, non-transferable license to use compute on the Service. Credits and subscription fees are non-refundable except where required by mandatory law. Unused credits expire upon termination of your account. Prices, included models, credit allowances, and features may change at any time.

If a chargeback or payment reversal occurs, we may suspend access immediately, debit the corresponding credits, and recover any costs incurred. Taxes (VAT, GST, sales tax) are calculated at checkout where applicable.

We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal personal or business purposes, strictly subject to these Terms and our Acceptable Use Policy.

You retain ownership of the inputs you submit ("Inputs") and, to the extent permitted by applicable AI providers and law, of the outputs generated for you ("Outputs"). You grant Tenairis a worldwide, royalty-free, sublicensable license to host, store, transmit, process, and display your Inputs and Outputs as necessary to operate, secure, and improve the Service, and to comply with law.

You represent and warrant that you own or have all necessary rights to your Inputs, that they do not infringe any third-party rights, and that the generation and use of Outputs by you complies with all applicable laws. AI Outputs are probabilistic and may be inaccurate, offensive, or similar to other outputs; you are solely responsible for evaluating and using them.

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated by reference. Violations may result in immediate suspension or termination, forfeiture of credits, and reporting to authorities.

Tenairis, including its software, models, designs, brand, and content, is owned by us or our licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership to you. You may not copy, reverse engineer, scrape, retrain, or create derivative works of the Service.

The Service relies on third-party providers (e.g. AI model providers, payment processors, hosting). We are not responsible for their acts, omissions, downtime, or pricing. Your use of those providers may be subject to their own terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, ORIGINAL, OR FIT FOR ANY PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENAIRIS, ITS AFFILIATES, AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM OR (B) EUR 50.

You agree to defend, indemnify, and hold harmless Tenairis and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Inputs or Outputs; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

We may suspend or terminate your access at any time, with or without cause and without notice. Upon termination, your right to use the Service ceases immediately and unused credits are forfeited. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, indemnity, governing law) survive.

We may modify, suspend, or discontinue any part of the Service at any time, including models, features, pricing, and credit costs, without liability.

These Terms are governed by the laws of Romania, without regard to conflict-of-laws rules. The competent courts located in Romania shall have exclusive jurisdiction over any dispute, except where mandatory consumer law grants you the right to sue in your country of residence. The UN Convention on Contracts for the International Sale of Goods does not apply.

If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them freely. These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Tenairis.
